Template Shop Policies

1. Introduction and Acceptance
1.1 These Template Shop Policies ("Policies") apply to all purchases of Squarespace templates, installation services and related resources from onlineprojectclub.com (the "Website"), operated by Homaira, trading as Online Project Club ("we", "us", "our"). By completing a purchase, you ("you", "the Customer") confirm that you have read and agree to these Policies.
1.2 You must be at least 18 years of age to make a purchase.
2. Products and Services
2.1 Our products consist of Squarespace website templates ("Templates") and the supporting materials provided with them, including written instructions, video tutorials, optional custom code and a library of reusable sections (together, the "Resources").
2.2 A Template is a design foundation and not a completed website. The Customer is responsible for supplying content, imagery and branding.
3. Delivery and Ownership
3.1 Following purchase, we will send the Customer an invitation to access the Template as a new Squarespace website with administrator permissions. We aim to do so within 24 hours of purchase. This period may be extended at weekends, on public holidays or due to circumstances outside our reasonable control.
3.2 If the invitation has not been received within [48 hours], the Customer should submit a support ticket.
3.3 Each Template is delivered once only. We are unable to reverse changes made by the Customer. A replacement copy, including where the invitation has not been accepted before the trial period ends, requires a further purchase.
3.4 A Template cannot be added to an existing Squarespace website unless the Installation Service described in Section 9 has been purchased.
3.5 We remain the Owner of the Squarespace website until the Customer has paid the price in full. Once payment is complete, we will transfer full ownership of the website to the Customer within [two (2) business days]. To receive ownership, the Customer must hold a Squarespace account. Until ownership is transferred, the Customer may build and edit the website but may be unable to change or purchase a Squarespace subscription, which the Customer should arrange once ownership has transferred. We will remove ourselves as a contributor after the transfer is complete. Transfer of ownership of the website does not transfer ownership of the intellectual property in the Template (see Section 5.4).
4. Squarespace Trial and Subscription
4.1 Each Template is delivered with a free Squarespace trial of three (3) months from the date the website is created. If the trial expires without a paid plan being in place, Squarespace may mark the website for deletion. We are unable to restore a deleted website, and a replacement copy requires a further purchase. The Customer should ensure that all payments are completed and ownership has been transferred in good time before the trial ends.
4.2 A Squarespace subscription is required to publish a website. Subscriptions, domain names, third-party tools and any other third-party fees are not included in the price of the Template.
5. Licence
5.1 On payment, we grant the Customer a limited, non-exclusive, non-transferable licence to use the Template and Resources for one (1) website, being either the Customer's own website or the website of one client.
5.2 The Customer may:
(a) modify the Template, including its colours, typography, imagery, copy and layout;
(b) duplicate pages and sections within the licensed website without limit; and
(c) use the Template for a client's website, provided that a separate licence is purchased for each client project.
5.3 The Customer may not:
(a) use the same Template on more than one website without purchasing a further licence;
(b) resell, redistribute, share, sublicense or otherwise make available the Template, its code, the section library or the tutorials to any other person;
(c) repackage the Template or any part of it for sale, whether as a template or any competing product;
(d) claim the design as solely the Customer's own creation; or
(e) use the custom CSS or other code supplied with the Template on any website not covered by the licence.
5.4 All intellectual property rights in the Templates, code, designs and Resources remain our property. The Customer acquires a licence to use them and does not acquire ownership.
6. Third-Party Materials
6.1 Demonstration images, illustrations and mockups included with a Template are provided for display purposes only and remain the property of their respective owners. The Customer must replace them with images the Customer owns or has licensed.
6.2 Fonts not supplied with Squarespace require a separate licence, which is the Customer's responsibility to obtain. We accept no liability for copyright or licensing issues arising from materials added or retained by the Customer.
7. Included Support
7.1 Each Template purchase includes ninety (90) days of email support from the date of purchase.
7.2 Support is provided by submitting a ticket through the support page. We aim to respond within [three (3) business days], Monday to Friday, excluding UK bank holidays.
7.3 Support covers: delivery and setup of the Template; the operation of the Template's features, settings and code; defects in the Template itself; and the effects of Squarespace updates on the Template.
7.4 Support does not cover: general Squarespace questions; modifications made to the Template or its code; third-party integrations, domains or hosting; custom design, copywriting, imagery or SEO; or design strategy.
7.5 Expiry of the support period does not affect the Customer's licence.
8. Included Benefits
The purchase price includes a 10% discount on a Squarespace subscription, where Squarespace's partner offer applies, and access to the video tutorial library for the duration of its availability. These benefits are subject to the availability and terms of the third parties concerned.
9. Installation Service (Optional)
9.1 Where the Customer purchases the "Installation on Existing Website" service, we will add the Template to the Customer's existing Squarespace website. The Customer must grant us the access we reasonably request through Squarespace's contributor permissions and must not share account passwords. We aim to complete the work within [two (2) business days] of receiving access.
9.2 We will take reasonable care not to disturb existing content. The Customer should back up the website beforehand, and we are not responsible for content lost or altered during installation except where caused by our failure to exercise reasonable care.
9.3 Installation does not include migration of existing content, restyling, content entry, or configuration of third-party tools.
10. Pricing and Payment
10.1 Prices are shown in [GBP (£)] [and include VAT where applicable]. Payments are processed by a third-party payment provider. We do not receive or store full payment card details.
10.2 The Customer confirms that the payment details provided are accurate and that the Customer is authorised to use them.
10.3 Where the Customer selects the payment plan, the Customer will pay two (2) instalments of £[X], the first at checkout and the second thirty (30) days later using the payment method provided at checkout. The total price under the payment plan is [the same as the price of paying in full].
10.4 If an instalment fails, we will notify the Customer, who will have [seven (7) days] to settle it. If it remains unpaid, we may remove the Customer's access to the website and suspend support, and we will retain ownership of the website until all sums due have been paid. The Customer remains liable for the full price.
11. Cancellation and Refunds
11.1 Delivery begins when we send the invitation to access the Template. Under the Consumer Contracts Regulations 2013, consumers ordinarily have 14 days to cancel a distance contract, but this right is lost for digital content once delivery has begun with the consumer's prior consent. At checkout, the Customer will be asked to consent to immediate delivery and to acknowledge that the statutory right to cancel is lost once delivery begins.
11.2 Separately from any statutory rights, if the Customer cancels before accepting the invitation to access the Template, we will cancel the pending invitation and refund the Customer in full, including any instalments already paid, within 14 days. Further instalments will not be collected.
11.3 Once the Customer has accepted the invitation, we do not offer refunds on grounds of change of mind. Transfer of ownership under Section 3.5 is an administrative step and does not affect this. Customers should review the demonstrations, feature descriptions and FAQs before purchasing and may contact us with questions beforehand.
11.4 If we are unable to deliver the Template, we will refund the Customer in full.
11.5 This Section is subject to Section 12.
12. Statutory Rights
12.1 Where the Customer is a consumer, digital content supplied must be as described, of satisfactory quality and fit for purpose. If a Template does not meet these requirements, the Customer should contact us. We will repair or replace it and, where that is not possible or proportionate, the Customer is entitled to a price reduction or refund in accordance with the Consumer Rights Act 2015.
12.2 Nothing in these Policies excludes or limits the Customer's statutory rights, or any liability that cannot lawfully be excluded or limited.
13. Limitation of Liability
13.1 Subject to Section 12.2, we are not liable for any loss that was not a reasonably foreseeable result of our breach, nor for loss of profit, revenue, goodwill or business opportunity.
13.2 We do not guarantee any particular result from the use of our Templates, including traffic, sales or earnings, and we are not liable for problems arising from modifications made by the Customer, third-party tools or changes made by Squarespace.
13.3 Subject to Section 12.2, our total liability arising from a purchase shall not exceed the price paid by the Customer for that purchase.
14. Access and Availability
14.1 Updates to a Template are included for as long as it is offered for sale. If we withdraw any Resource, we will give at least [30 days'] notice so that the Customer can retain a copy.
14.2 Resources are hosted by third parties. We do not guarantee uninterrupted access but will take reasonable steps to restore any interruption.
15. Acceptable Use and Termination
15.1 The Customer must use the Templates and Resources lawfully and must not infringe the rights of others.
15.2 We may withdraw the Customer's licence for a serious breach of these Policies, having first given written notice stating the reason and a reasonable opportunity to remedy the breach where it can be remedied. Any refund in these circumstances will be determined in accordance with applicable consumer law.
16. Showcasing
We may display demonstration versions of our Templates in our marketing. We will feature a Customer's completed website only with that Customer's prior consent.
17. Squarespace Trademark
"Squarespace" is a registered trademark of Squarespace, Inc. Online Project Club is not affiliated with, sponsored by or endorsed by Squarespace, Inc.
18. Privacy
Our collection and use of personal data is described in our Privacy Policy.
19. Changes to these Policies
We may amend these Policies from time to time. Material changes will be published on this page with an updated date. The version in force at the time of purchase applies to that purchase.
20. Governing Law
These Policies are governed by the laws of England and Wales. Consumers retain any mandatory rights they hold under the laws of their country of residence, including the right to bring proceedings in their local courts.
